1. Agreement to Terms
These Terms and Conditions govern the provision of remote technical support services offered by Clean AI (a commercial brand of Macons LLC), through the website cleanai.mx.
By purchasing our services, you agree to be bound by these Terms and Conditions in their entirety.
2. Service Description
Clean AI provides remote technical support services for computer systems, including:
- Diagnostics: System status analysis, performance issue detection, malware detection, and configuration review
- Cleanup: Removal of temporary files, cache, unnecessary programs, and detected malware
- Optimization: System parameter configuration to improve speed, stability, and security
2.1 Remote Connection
Service delivery requires remote access to your device, which is performed as follows:
- Through an encrypted tunnel (SSH), ensuring connection security
- Access is temporary and supervised: initiated only with your authorization and closed upon completion of each session
- No permanent access programs are installed without your express consent
- All actions performed are recorded in a session log available to you upon request

All prices are in United States Dollars (USD). Applicable taxes are included where required by law. Promotional prices are subject to availability and may change without prior notice.
4. Monthly Plan
Customers who opt for a monthly service plan accept the following conditions:
- Frequency: Up to 4 cleanups per month included in the plan
- Minimum interval: At least 1 day must elapse between each cleanup
- The monthly cycle starts on the date of purchase and renews automatically
- Unused sessions in a billing cycle do not carry over to the next cycle
5. Scope and Limitations
5.1 What the Service Covers
- Diagnostics, cleanup, and optimization of your device according to the purchased plan
- Removal of temporary files, cache, and unwanted software
- Detection and removal of malware identified during diagnostics
- Configuration adjustments to improve overall performance
5.2 What the Service Does NOT Cover
Important
The service does not guarantee recovery of lost data. If damaged or deleted files are detected during the cleanup process, Clean AI will not be liable for information loss.
- Recovery of lost, deleted, or damaged data
- Hardware repair or physical component replacement
- Guarantee of specific speed or quantifiable performance metrics
- Resolution of issues caused by the Customer after the session
5.3 Customer Recommendations
Before each remote support session, we recommend:
- Backing up important data
- Closing open applications and documents
- Informing us of any specific issue or files that should NOT be modified
6. Limitation of Liability
IN NO EVENT SHALL CLEAN AI'S TOTAL LIABILITY TO YOU FOR ANY CLAIM RELATED TO THE SERVICE EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE SERVICE THAT IS THE SUBJECT OF THE CLAIM.
This limitation applies to:
- Direct, indirect, incidental, or consequential damages
- Loss of data, lost profits, or business interruption
- Any other claim arising from the use or inability to use the service
Clean AI shall not be liable for damages arising from:
- Pre-existing device conditions prior to the service
- Actions or omissions by the Customer after the support session
- Force majeure or causes beyond the scope of the service provided
- Customer's internet connection failures during the session
TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW, CLEAN AI DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
7. Cancellation and Refund Policy
7.1 Cancellation by Customer
- You may cancel your monthly plan at any time
- Cancellation takes effect at the end of the current billing cycle
- Completed sessions are non-refundable

7.2 Cancellation by Clean AI
- Clean AI reserves the right to cancel service if you breach these Terms
- Cancellation will be notified with at least 3 business days advance notice
- A prorated refund will be issued for unused days in the current cycle
7.3 Refund Policy
- 30-day money-back guarantee: If you are not satisfied with the service, you may request a full refund within 30 days of purchase
- Services not yet started: full refund
- Partially completed services: prorated refund
- Completed services: not eligible for refund
- Refunds are processed within 5 to 10 business days to the original payment method
8. Payment Terms
- All payments are processed in United States Dollars (USD) via Stripe secure payment processing
- Accepted payment methods: credit cards and debit cards (Visa, Mastercard, American Express)
- Monthly plan subscriptions are billed automatically at the start of each billing cycle
- Prices are subject to change with prior notice. Changes will not affect current billing cycles
- By providing your payment information, you authorize Macons LLC to charge the applicable fees
9. Customer Obligations
- Provide truthful and complete information when purchasing the service
- Allow remote access to your device via the method indicated by Clean AI (SSH tunnel)
- Do not interfere with or interrupt remote support sessions while in progress
- Maintain a stable internet connection during the session
- Inform us of any particular condition of your device before the session (critical files, protected software, etc.)
- Back up important data before each session
10. Privacy and Data Protection
The processing of personal data is governed by our Privacy Policy, which is an integral part of these Terms and Conditions.
During the remote session, Clean AI accesses only the files and systems necessary for service delivery. We do not access personal documents, photographs, emails, or other files unless expressly authorized by you.
10.1 CCPA — California Consumer Privacy Act
Under the California Consumer Privacy Act (CCPA), California residents have the right to:
- Know: Request disclosure of what personal information is collected and how it is used
- Delete: Request deletion of personal information we have collected
- Opt-out: Opt out of the sale of personal information (we do not sell your data)
- Non-discrimination: Exercise privacy rights without discriminatory treatment

10.2 GDPR — European Clients

11. Intellectual Property
- The "Clean AI" brand, its logo, and the content of the cleanai.mx website are the property of Macons LLC
- The tools, scripts, and methodologies used during the service are the intellectual property of Clean AI
- You retain all rights to your own content and data
12. Export Compliance
Our services are provided from the United States and are subject to U.S. export controls. By using our services, you represent and warrant that:
- You are not located in, or a national of, any country subject to a U.S. Government embargo
- You are not on any U.S. Government list of prohibited or restricted parties
- You will not use our services for any purpose prohibited by U.S. law, including export control laws
- You will comply with all applicable U.S. and local laws and regulations regarding the use of our services
13. Modifications to Terms
Clean AI reserves the right to modify these Terms and Conditions at any time. Changes will be posted at:
Continued use of the service after changes are posted constitutes acceptance of the new terms. If you do not agree with the changes, you may cancel the service in accordance with Section 7.
14. Dispute Resolution and Arbitration
Any disputes arising out of or relating to these Terms shall be resolved as follows:
14.1 Informal Resolution
You agree to first attempt to resolve any dispute by contacting Clean AI at contacto@macons.com. We will attempt to resolve the dispute informally within 30 days.
14.2 Binding Arbitration
If the dispute is not resolved informally, you agree to resolve any and all disputes through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
- Arbitration shall be conducted in San Diego County, California
- The arbitration shall be conducted by a single arbitrator
- The arbitrator's decision shall be final and binding
- This arbitration agreement does not prevent you from seeking relief in small claims court for disputes within its jurisdiction
14.3 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
15. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law provisions.
For the interpretation and enforcement of this agreement, the parties submit to the jurisdiction of the state and federal courts located in San Diego County, California, USA, waiving any other jurisdiction that might correspond to them by reason of their present or future domiciles.
